Terms of Use
1. Acceptance
By downloading and using the Trypup app you agree to these terms. If you disagree, do not use the app. The contract for use of the app is concluded with the operator, OndysLab s.r.o.
2. Service description
Trypup is an educational simulator of dog care for education and entertainment. In Dog at home mode it is also a helper for keeping records of the care of a real dog: it lets you keep a diary, a care plan and reminders and store a digital copy of the dog's passport. It is not a substitute for veterinary, training or other professional care of a real animal, and the digital copy of the passport does not replace the official passport or any other documents. In-app information (costs, vaccinations, articles) is indicative.
3. User age
The app is intended for users aged 13 and over (App Store and Google Play rating). Users under 16 use it with the consent of a parent or legal guardian; the app does not offer them purchases and does not collect analytics about them (see the Privacy Policy). A user under 16 creates an account only with a parent's consent; a parent may request its deletion at any time.
4. No veterinary advice
Health and cost content is general and educational, including in Dog at home mode (e.g. first-aid tips). For a real dog, always follow the advice of a licensed veterinarian; in an emergency, call a vet. The owner is responsible for the dog's care and for meeting legal obligations (e.g. rabies vaccination or microchip registration). Reminders in the app are an aid: their delivery depends on your phone and its settings (e.g. battery saving), so keep track of important dates yourself as well.
5. Account and shared care
An account is optional — it backs up your saved progress and your dog's details from Dog at home mode, and enables shared care of a dog with your family. You are responsible for your credentials and for actions taken under your account. The dog's owner can add members with an invite code and remove them at any time; a member sees the dog's state, completed tasks and the display names of other members, and can leave at any time. We may end sharing if it is abused. You can delete your account directly in the app (Profile → Account → Delete account) or via the Delete account page.
6. Premium, payments and the seller
The app offers optional paid features (Premium subscription and individual breeds). These purchases are sold and billed by the operator of the relevant store — Apple (App Store) or Google (Google Play) — who acts as the seller toward you. Prices are shown in the store including all taxes; OndysLab s.r.o. is not a VAT payer, and the store handles tax and the tax receipt. Subscriptions renew automatically at the displayed price until you cancel them in the subscription settings of the App Store or Google Play — at least 24 hours before the end of the current period. Previously purchased features can be restored on a new device with the “Restore purchases” button in the app.
7. Withdrawal and refunds
Because the seller is Apple or Google, withdrawal from a purchase and refunds are governed by the rules of the relevant store. You request a refund in the App Store (reportaproblem.apple.com) or in Google Play. Please note that for digital content supplied online, the right of withdrawal ceases under Section 1837(l) of the Czech Civil Code once performance has begun with your prior express consent and acknowledgement that you lose that right.
8. Defects and complaints for digital content
We strive to keep the digital content conforming to its description and functional, and we provide updates necessary to maintain it. As a consumer you have the statutory rights arising from defective performance under the Czech Civil Code. Report a defect or problem to hello@trypup.life; refunds are handled by the store where you made the purchase.
9. Acceptable use
You must not misuse the app, spoof GPS data, decompile it, circumvent its protective mechanisms or break applicable law. Shared-care invite codes are meant only for the people you really share the dog with — do not publish them.
10. Licence and content
The app, its texts, icons, graphics and educational articles are protected by the operator's copyright. We grant you a non-exclusive, non-transferable licence for personal, non-commercial use of the app. Data you enter into the app (such as your dog's name) remain yours; you allow us to store them and show them to shared-care members to the extent needed for the service to work.
11. Availability and termination of the service
We develop the app continuously and may change it, temporarily limit it or discontinue it. We provide the cloud backup with professional care, but game progress has no monetary value and we do not compensate its loss due to an outage, deleting the app or discontinuing the service. We will give reasonable notice in the app before discontinuing the service.
12. Limitation of liability
The app is provided "as is". To the maximum extent permitted by law we are not liable for indirect damages from its use. Nothing in these terms limits consumer rights under Czech and EU law.
13. Out-of-court dispute resolution
The Czech Trade Inspection Authority (Česká obchodní inspekce, Gorazdova 1969/24, 120 00 Prague 2, ID 000 20 869, adr.coi.cz) is competent for out-of-court resolution of consumer disputes. Cross-border disputes are assisted by the European Consumer Centre Czech Republic (evropskyspotrebitel.cz). You can also send a complaint to hello@trypup.life; we will inform you of its handling by email. Consumer-protection supervision is exercised by the Czech Trade Inspection Authority and personal-data supervision by the Office for Personal Data Protection. We are not bound by any codes of conduct within the meaning of Section 1820(1)(n) of the Czech Civil Code.
14. Privacy
How we process personal data is described in our Privacy Policy.
15. Final provisions
We may amend or supplement these terms; the new wording will be published on this page. If any provision is invalid or ineffective, it is replaced by a provision closest in meaning, and the validity of the remaining provisions is unaffected.
This relationship is governed by the law of the Czech Republic; this choice does not deprive you as a consumer of the protection of mandatory provisions that would otherwise apply (Art. 6 of the Rome I Regulation).
